What the Graves Act Means for Your Case

New Jersey enforces some of the strictest firearms laws in the country. Most illegal gun possession offenses are graded as second-degree crimes, carrying 5 to 10 years in prison and fines up to $150,000. The Graves Act (N.J.S.A. 2C:43-6) makes mandatory prison time the default for most gun offenses, regardless of whether you have a prior record. The mandatory parole ineligibility period is either one-third to one-half of the sentence imposed or 42 months, whichever is greater.

Third-degree gun offenses carry 3 to 5 years and fines up to $15,000. Fourth-degree offenses carry up to 18 months and fines up to $10,000. For certain violent offenses involving a firearm, the No Early Release Act (NERA) prohibits parole eligibility for 85 percent of the sentence. These aren’t abstract ranges. They represent real time in a New Jersey state prison.

One potential path is a Graves Act waiver under N.J.S.A. 2C:43-6.2, which can reduce the mandatory minimum to one year of parole ineligibility or open the door to probation or Pre-Trial Intervention (PTI). Neither is automatic. Both require the Morris County Prosecutor’s Office to consent, and both demand a carefully constructed argument on your behalf.

Gun Charges Handled in Morris County Superior Court

Gun cases in Morris County span a range of specific offenses. The charges I most often defend against include:

Unlawful Possession of a Weapon (N.J.S.A. 2C:39-5)
Charged when a person possesses a handgun, rifle, shotgun, or assault firearm without the required New Jersey permit. Out-of-state residents who bring a legally owned firearm into New Jersey without a NJ permit face the same charge. Handgun possession without a permit is a second-degree crime. BB guns, airsoft guns, and pellet guns fall under this statute as third-degree offenses.

Possession of a Weapon for an Unlawful Purpose (N.J.S.A. 2C:39-4)
Charged when a firearm is used or threatened to be used against a person or property. Handgun possession for an unlawful purpose is a first-degree crime.

Certain Persons Not to Possess Weapons (N.J.S.A. 2C:39-7)
Applies to individuals with prior felony convictions, those subject to restraining orders, or those with certain mental health adjudications. This charge frequently compounds an existing record.

Additional Charges
Possession of prohibited weapons or devices (N.J.S.A. 2C:39-3), unlawful disposition of a firearm (N.J.S.A. 2C:39-9), and aggravated assault with a deadly weapon (N.J.S.A. 2C:12-1(b)) round out the charges I see most often. Gun offenses are frequently filed alongside burglary, robbery, drug charges, or domestic violence allegations, which can compound total sentencing exposure significantly.

How I Defend Gun Charges in Morris County

Every gun case starts with a thorough review of how the firearm was discovered. The Fourth Amendment protects against unreasonable searches and seizures, and if police recovered the weapon through an unlawful stop or search, I file a motion to suppress that evidence. When a court grants suppression and excludes the firearm, the prosecution’s case may be significantly weakened. It’s one of the most powerful tools available in these cases.

Beyond suppression, I examine whether the state can actually prove knowing possession. Constructive possession cases, where the firearm was found nearby but not on the defendant, require the prosecution to establish that the defendant knew about the weapon and had control over it. That’s not always easy to prove.

For eligible first-time offenders, I pursue a Graves Act waiver, which can mean probation or a reduced mandatory minimum if the Morris County Prosecutor’s Office consents. PTI may be available even for some second-degree gun offenses, depending on the circumstances and the absence of a prior record. When neither applies, negotiating a downgrade from a second-degree to a third-degree charge can still dramatically reduce prison exposure. If the case goes to trial, the state must prove every element beyond a reasonable doubt, and I hold them to that standard.

How a Morris County Gun Case Proceeds After Arrest

Gun charges in Morris County are handled by the Criminal Division of the Morris County Superior Court in Morristown. Most are issued on warrant complaints, meaning you’re processed and brought before a judge at Central Judicial Processing (CJP) within 24 to 48 hours of arrest. At CJP, the judge advises you of the charges and decides on release conditions.

New Jersey doesn’t use cash bail in most cases. Instead, judges impose conditions such as phone reporting, in-person reporting, house arrest, or electronic monitoring. If the Morris County Prosecutor’s Office moves for detention, a hearing is scheduled within three working days, and probation prepares a Public Safety Assessment scoring your risk of reoffending and failure to appear. Released defendants are assigned to a Pre-Trial Monitoring level with reporting requirements that vary by risk score.

After initial proceedings, the case moves to a pre-indictment conference before the Morris County Superior Court, where early plea negotiations may begin. The earlier I’m involved, the more options I may have to investigate, prepare motions, and engage the prosecutor before positions harden.
