A person found to have in their possession at least two credit cards with other names can be accused of credit card theft. It is also against the law to take another's credit card to secure a debt. Most credit card thefts are fourth degree offenses, and that can often result in at least 18 months in state prison and other penalties. In some circumstances, the charges may be in the third degree with a 5-year prison sentence and additional penalties.
