Specific Time Limits for Certain Offenses
For the most part, a traffic violation summons must be issued within 30 days of the infraction. However, specific offenses have later deadlines.
Under N.J.S.A. 39:5-3, complaints could be made to judges as follows:

Within 90 days for the following violations:
- Driving while intoxicated
- Driving while license suspended
- Driving a commercial vehicle while under the influence of alcohol or a controlled substance
- Refusing to take a breath sample
- Failing to stop for a school bus

Within 1 year after the commission of the offense for:
- Illegally securing a license plate
- Applying for a driver’s license during a suspension
- Falsifying information on a motor vehicle or driver’s license application, or on examination material
- Leaving the scene of an accident
