The client was charged with both a second DWI offense and a third DWI offense and brought before the Montville Township Municipal Court.
The penalties for the second DWI offense could have included a two-year loss of driving privileges. For the charge of a third DWI offense, our client could have lost driving privileges for 10 years, as well as a mandatory 180-day incarceration. In other words, our client’s personal and professional lives were at stake, as losing driving privileges for such a long time is entirely devastating.
To bring the case to a workable, acceptable conclusion, Attorney Porreca communicated with the prosecutor assigned to the case. He had found various legal issues with the opposition’s case against our client, and knew they could be used as leverage. After a round of discussions, the prosecutor agreed to dismiss the third offense completely, as well as downgrade the second offense to a first-time DWI offense for sentencing purposes.
The final plea offer involved our client pleading guilty to a first offense DWI, and surveying only a one-year suspension of their driver's license. Perhaps best of all, our client served no jail time at all. This is a monumental success for our client, who has shown appreciation for our efforts.
