Mr. Porreca recently represented a defendant charged with several counts of Aggravated Assault and
Child Endangerment in Passaic County Superior Court. Mr. Porreca was able to convince the
Prosecutor’s office to remand the assault charges to the local municipal court. After meeting with
the prosecutor and discussing the weaknesses of the State’s case, Mr. Porreca was able to convince
the Prosecutor to dismiss all charges.


Mr. Porreca represented a defendant in West Milford Municipal Court on a violation of N.J.S.A.
39:4-50 (DWI). The defendant had a reading of .12% BAC. Mr. Porreca was able to convince the
prosecutor to downgrade the DWI to a “Tier 1" offense with only a 90 day loss of the defendant’s
driving privileges. All other traffic summonses were dismissed.


Mr. Porreca represented a defendant in Morris Township Municipal Court on a violation of N.J.S.A.
39:4-50 (DWI). The defendant had a reading of .16% BAC. After meeting with the prosecutor, Mr.
Porreca was able to have the DWI downgraded to a “Tier 1" offense with only a 90 day loss of the
defendant’s driving privileges. All other traffic summonses were dismissed.


Mr. Porreca represented a defendant in the Parsippany Municipal Court charged with Possession of
Marijuana under N.J.S.A. 2C:35-10(a)(4), along with Possession of Drug Paraphernalia under
N.J.S.A. 2C:36-2. This defendant was also charged with Possession of CDS While Operating a
Motor Vehicle under N.J.S.A. 39:4-49.1, along with violations of Driving in the Right Lane under
N.J.S.A. 39:4-88(a) and Failure to Maintain Lane under N.J.S.A. 39:4-88(b). Also charged in the
case were two other co-defendants. After reviewing discovery and the facts of the case with the
prosecutor, as well as counsel for the co-defendants, Mr. Porreca was able to have all charges against the client dismissed, including all traffic summonses.


Mr. Porreca represented a defendant in the Parsippany Municipal Court on a violation of N.J.S.A.
39:4-50 (DWI) who had a reading of .19% BAC, Reckless Driving under N.J.S.A. 39:4-96, Leaving
the Scene of an Accident under N.J.S.A. 39:4-129(b) (which carries an additional license suspension
of six months) and Failure to Report an Accident under N.J.S.A. 39:4-130. After negotiating with
the prosecutor, Mr. Porreca was able to have the DWI offense downgraded to a “Tier 1" with only
a 90 day loss of the defendant’s driving privileges.


Mr. Porreca represented a defendant in the Rockaway Township Municipal Court charged with
Possession of Marijuana under N.J.S.A. 2C:35-10(4), Driving While Intoxicated under N.J.S.A.
39:4-50, Reckless Driving under N.J.S.A. 39:4-96 and Possession of CDS in a motor vehicle under
N.J.S.A. 39:4-49.1. After discussing the strengths and weaknesses of the State’s case with the
Prosecutor, Mr. Porreca was able to get all matters dismissed.


Mr. Porreca represented a defendant in Morris County Superior Court charged with Conspiracy to
Commit Insurance Fraud under N.J.S.A. 2C:5-2 and Insurance Fraud under N.J.S.A. 2C:2-4.6. Mr.
Porreca was able to successfully enroll the defendant in the Pre-Trial Intervention Program.
Mr. Porreca represented a defendant charged with Simple Assault under N.J.S.A. 2C:12-1(a) as well
as Theft under N.J.S.A. 2C:20-3(a) in Morris County Superior Court. After discussions with the
Morris County Prosecutor’s Office, Mr. Porreca was able to have the case remanded to the Morris
Plains Municipal Court. After negotiations with the Prosecutor there, Mr. Porreca was able to have
these criminal charges completely dismissed.


The defendant also had a Temporary Restraining Order entered against him in the Passaic
County Superior Court. After discussions with the alleged victim’s counsel, Mr. Porreca was able
to have the Temporary Restraining Order dismissed.


Mr. Porreca represented a defendant in the Mount Arlington Municipal Court on Possession of
Marijuana under N.J.S.A. 2C:35-10(a)(4), Possession of Drug Paraphernalia under N.J.S.A. 2C:36-2,
Unsafe Lane Change under N.J.S.A. 39:4-88(b) and Having an Open Container of Alcohol in a
Motor Vehicle under N.J.S.A. 39:4-51(b). After meeting with the Prosecutor, Mr. Porreca was able
to have the possession downgraded to Loitering for the Purposes of Obtaining CDS under N.J.S.A.
2C:33-2.1; the paraphernalia charge was dismissed along with all traffic summonses.


Mr. Porreca represented a defendant with immigration issues in the Wayne Township Municipal
Court charged with Shoplifting under N.J.S.A. 2C:20-11(b)(1). After meeting with the Prosecutor,
Mr. Porreca was able to have this disorderly persons offense downgraded to Disorderly Conduct
under N.J.S.A. 2C:33-2(a)(2). This offense would not effect defendant’s immigration status.


Mr. Porreca represented a defendant in the Mount Olive Municipal Court charged with Possession
of Under 50 grams of Marijuana under N.J.S.A. 39:35-10(a)(4). After meeting with the Prosecutor,
Mr. Porreca was able to have the charge downgraded to a loitering charge under N.J.S.A. 2C:33-21.
Mr. Porreca represented a defendant in the Morristown Municipal Court charged with Speeding
under N.J.S.A. 39:4-98. After meeting with the Prosecutor, Mr. Porreca was able to have the charge
downgraded to Unsafe Driving with zero points under N.J.S.A. 39:4-97.2.


Mr. Porreca represented a defendant in the Parsippany Municipal Court charged with Careless
Driving under N.J.S.A. 39:4-97. After meeting with the Prosecutor, Mr. Porreca was able to have
the charge downgraded to Delaying Traffic with zero points under N.J.S.A. 39:4-56.
