How do I obtain my criminal background?
It always useful for our office to have your Criminal Case History (CCH). Your prior record, if you have one, can absolutely affect the way that State treats your case and any plea offers that they will extend. While this document is usually provided in discovery by the State, it is very important to know for Mr. Porreca to know your criminal history going into a case. We cannot obtain this information. You must obtain your CCH. This can be done via the New Jersey State Police website.
To obtain your own criminal history (rap sheet) in New Jersey, you must schedule a fingerprinting appointment through
IdentoGO using code 2F1BJG for a personal record request. The process requires bringing government-issued identification to an approved location and paying a $42.80 fee. For public criminal case searches, you can use the NJ Courts website.

If I think I can defend myself, should I talk to the police? No. Despite your first impulse to begin defending yourself, the wisest thing you can do for yourself is remain silent until your criminal defense attorney arrives at the police station. Being arrested is nerve-racking and when people are nervous, they can share information that will end up hurting them down the road. The police officers arresting you have one objective and that is to gather enough evidence for the prosecution to incriminate you, this may or may not include the information you share with them. A legal professional will know the right time to share the right information in order to protect you from conviction.
-
If I am arrested, do the police have to read me my rights?Your Miranda rights must be read to you if any statement you make can be used against you. If the case against you is strong enough that the prosecution does not need a statement from you in order to proceed, the police do not have to read you your rights. The Miranda warning is required only when the prosecution intends on using your statements at trial. Never agree to speak to anyone until you consult a skilled lawyer from my firm.

Have you been accused of driving while intoxicated? Depending on the severity of your charges and the circumstances surrounding your arrest, DWI may be punishable by prison time and exorbitant fines. According to the State of New Jersey Motor Vehicle Commission (MVC), the only scientific way to determine whether or not a motorist is driving under the influence of alcohol is through a blood Alcohol concentration (BAC) test. In most cases, BAC is tested with a Breathalyzer test.
