Recently, our firm was retained to represent a client facing shoplifting charges in Morris Plains Municipal Court. Shoplifting charges in New Jersey can lead to misdemeanor or felony convictions and include strict penalties such as jail time and costly fines. After multiple court appearances and unfaltering criminal defense representation, Attorney Porreca was able to get the charges dismissed for lack of prosecution by the State.

Likewise, we represented a defendant charged with theft in Rockaway Municipal Court. After persistent negotiations with the prosecutor and the loss-prevention agent from the store, the charges were completely dismissed, and the matter settled by restitution ordered by the court.

Additionally, our founding lawyer also represented a defendant charged with a second offense DWI in Parsippany Municipal Court. After running out of gas, our client pulled their vehicle over for an unknown length of time before being discovered by the police. When the officers investigated the car, they found several open bottles of alcohol. However, Attorney Porreca used his knowledge of the law to argue the “glove box” defense, also known as the post-operation consumption defense. Essentially, the State could not prove that the defendant was intoxicated while driving or before pulling over.

Another recent case involved a defendant facing charges for possessing 50 grams or less of marijuana in his motor vehicle. Per Denville Municipal Court, this is a disorderly persons offense, which can lead to jail time. By negotiating with the prosecutor and the co-defendant’s lawyer, Attorney Porreca was able to get these charges dismissed.
