How To Obtain Your History of Arrests and Convictions
Expungement Lawyers in New Jersey™ usually recommends that persons needing a copy of their arrest record obtain it from the Federal Bureau of Investigation (FBI). The FBI record will provide information about events that may have occurred in New Jersey plus the other forty-nine states, Puerto Rico, the District of Columbia, and federal courts, including the United States Armed Forces. Further, it is actually easier and less expensive to obtain the fifty-state FBI record than it is to obtain a record of just New Jersey.
You can obtain a copy of your FBI record in any of three ways. Using any of the three ways, if asked reason for the request, specify “for Personal Review,” not “for Expungement.” The three ways are:
Submit a request to the FBI using an “FBI Channeler.” One channeler about which Expungement Lawyers in New Jersey™ has received positive feedback from clients is Fieldprint;
Submit an electronic request to the FBI; and
Mail a request on paper to the FBI using U.S. Postal Service.
Of the three ways, using the “FBI Channeler” seems to usually be the fastest. A page on the web site of the FBI gives step by step instructions for each of the three ways.
All three ways involve your jumping through some hoops. After this jumping, the information that you obtain may still be incomplete. (We never told you it would be simple.) For example, the procedures described above sometimes omit juvenile records, and records of events in municipal courts.
Municipal court history is most likely to be omitted when fingerprinting was not done during processing. Where juvenile records exist, pertinent information can be obtained from the courts directly. Municipal court records can usually be obtained from the municipal courts themselves. Even though information is omitted from State Police or FBI records, prosecutors will nonetheless object to the expungement when they find the information elsewhere.
