What Is “Child Endangerment?”

N.J.S. 2C:24-4 defines the offense of Endangering the Welfare of Children. The definition is, in fact, broad and encompasses the many ways an offender can take inappropriate action with a child related to child pornography. In the state of New Jersey, a child is defined as anyone under the age of 16.

Offenses included in the N.J.S. 2C:24-4 statute include:

  • Allowing a child to participate in child pornography
  • Producing (or recording/photographing) child pornography
  • Distributing or selling child pornography
  • Possessing or knowingly viewing child pornography

The penalties for child endangerment vary depending on which offense under the statute applies to the defendant. For instance, possessing child pornography is a crime of the fourth degree, which can include up to 5 years in prison and fines up to $10,000. Conversely, allowing a child to participate in child pornography is a second degree crime, which can come with up to 10 years in prison and $150,000 in fines.
